These Terms and Conditions ("Terms") govern your access to and use of the Smart Stock web application, the Smart Stock marketing website (smartstock.pk), and the Smart Stock mobile application (collectively, the "Services"), operated by Smart Stock ("we", "us", "our"). By registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
To use Smart Stock, you must register for an account by providing accurate, complete, and current information about your business, including your business name, email address, and contact details. You are responsible for keeping this information up to date. Each account is issued to a single business entity. You must be legally authorised to enter into this agreement on behalf of the business you register.
New accounts are eligible for a fourteen (14) day free trial of the Smart Stock Services. No payment is required during the trial period. At the end of the trial period, continued access to the Services requires an active paid subscription. We reserve the right to modify or discontinue the free trial offer at any time without prior notice.
Smart Stock is offered as a subscription-based service. You may choose from the following billing cycles: monthly, every six (6) months, or annually. The subscription price is the same regardless of the billing cycle you select. Payment is due at the start of each billing period. Failure to maintain an active payment may result in suspension of your account as described below.
Our subscription pricing is not fixed for the lifetime of your account. Pricing may be revised periodically due to factors including but not limited to increases in hosting and infrastructure costs. We commit to revising pricing no more than once per calendar year. You will be notified of any price change at least thirty (30) days before it takes effect. If you do not wish to continue at the revised price, you may cancel your subscription before the effective date. Continued use of the Services after the effective date constitutes your acceptance of the revised pricing.
All subscription fees are non-refundable. We offer a fourteen (14) day free trial so that you may evaluate the Services before committing to a paid subscription. No refunds will be issued for any subscription fees paid, whether for partial or unused periods, or in the event of account suspension or termination due to a violation of these Terms.
Each subscription permits the operation of a maximum of three (3) branches within a single account. If your business requires more than three branches, an additional subscription must be purchased. We reserve the right to restrict access to branches that exceed the permitted limit under your subscription.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including actions taken by staff members you grant access to. You agree to notify us immediately at info@smartstock.pk if you become aware of any unauthorised use of your account. Smart Stock shall not be liable for any loss or damage arising from your failure to maintain the security of your account.
Your Smart Stock subscription and account are granted to the registered business entity only. Subscriptions are non-transferable and may not be assigned, sublicensed, or otherwise transferred to any other individual, business, or entity without prior written consent from Smart Stock.
You agree to use the Smart Stock Services for lawful business purposes only. You must not use the Services to create or process fraudulent records or transactions, engage in any activity that violates applicable Pakistani or international law, attempt to gain unauthorised access to any part of the platform or another tenant's data, reverse engineer, copy, or replicate any part of the Smart Stock software or platform, or use the Services in any way that could damage, disable, or impair the platform or its infrastructure. We reserve the right to suspend or permanently terminate any account found to be in violation of this section without prior notice and without refund.
Smart Stock, including its software, design, features, functionality, and all related content, is the exclusive property of Smart Stock and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights over the platform or any part of it. You retain full ownership of the business data you input into the system.
We maintain automated backups of your data on a rolling basis as part of our service commitment. These backups are managed entirely by Smart Stock and are not accessible to account holders. During your active subscription, you may export your business data using the export tools available within the application, such as PDF reports and CSV exports. Upon account termination, Smart Stock does not provide raw database exports or data in any technical format. We strongly encourage you to export all records you require while your account remains active.
For accounts on whose behalf Smart Stock has imported a bulk product catalogue, we reserve the right to permanently remove products that have not appeared in any sale or purchase transaction for a continuous period of twelve (12) months. Account holders will be notified thirty (30) days prior to any such removal. During this period, products may be retained by recording a transaction against them or by contacting us at info@smartstock.pk. Smart Stock shall not be liable for removals carried out in accordance with this policy.
Your data is retained for as long as your account remains active. Following cancellation or termination of your account for any reason, your data will be retained for fifteen (15) days, after which it will be permanently and irreversibly deleted from our systems. Smart Stock shall bear no liability for data that is lost following the expiry of this retention period.
We reserve the right to suspend or terminate your account at our sole discretion in the event of non-payment of subscription fees, a violation of these Terms, or any activity that we reasonably believe poses a risk to the platform, other tenants, or third parties. During a suspension due to non-payment, your data remains intact and the fifteen-day retention period does not begin until formal termination. We will make reasonable efforts to notify you before taking such action except where immediate suspension is necessary to protect the platform or other users.
We reserve the right to modify, update, or discontinue any feature or aspect of the Smart Stock Services at any time. We will endeavour to notify account holders of significant changes in advance. Smart Stock shall not be liable for any loss or inconvenience resulting from changes to or discontinuation of any feature of the Services.
We strive to maintain consistent availability of the Smart Stock Services but do not guarantee uninterrupted, error-free, or completely secure operation. Planned maintenance will be communicated where possible. Smart Stock shall not be liable for any business losses, lost revenue, or damages of any kind resulting from service downtime or unavailability.
To the fullest extent permitted by applicable law, Smart Stock and its operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or inability to use, the Services. Our total aggregate liability to you under these Terms shall not exceed the subscription fees you paid in the one (1) calendar month immediately preceding the event giving rise to the claim.
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising out of or in connection with these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Pakistan. We encourage you to contact us first at info@smartstock.pk to attempt to resolve any dispute informally before initiating formal proceedings.
We may update these Terms from time to time. We will notify you of significant changes via email or through a notice within the application. Your continued use of the Services after the effective date of any revision constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.
